(A) Any member not covered by a collective bargaining agreement with one or more years of credited service, who retires due to disability as provided in § 36.35, shall receive a pension equal to 2% of the member's average final compensation multiplied by his years and fraction of a year of credited service; however, no disability pension shall be less than 20% of the member's average final compensation. Upon his retirement, he shall have the right to elect an option provided for in § 36.19(B). (‘83 Code, § 36.36)
(B) Any member with less than ten years of credited service who retires due to disability, as provided in § 36.35, and is receiving workmen's compensation benefits on account of a disability arising out of and in the course of his city employment, shall have his credited service increased to ten years. Upon his retirement, he shall have the right to elect an option provided for in § 36.19(B). (‘83 Code, § 36.37)
