§ 36.17 SERVICE RETIREMENT.
   (A)   Any member who has attained or attains his voluntary retirement age, and who has ten or more years of total service, may retire from city service upon his written application filed with the Board setting forth at what time he desires to be retired, not less than 30 days or more than 90 days subsequent to the execution and filing thereof.
   (B)   In accordance with § 401(a)(9) of the Internal Revenue Code and the regulations thereunder, which are incorporated herein by reference, a member's pension shall be distributed to him or her not later than April 1 of the calendar year following the later of the following.
      (1)   The calendar year in which the member attains age 70-1/2 years.
      (2)   The calendar year in which the member retires.
   (C)   With respect to distributions under the retirement system made for calendar years beginning on or after January 1, 2001, the minimum distribution requirements of § 401(a)(9) of the Internal Revenue Code will be applied in accordance with the regulations under § 401(a)(9) that were proposed on January 17, 2001, notwithstanding any provision of this chapter to the contrary. This amendment shall continue in effect until the end of the last calendar year beginning before the effective date of final regulations under § 401(a)(9) or such other date as may be specified in guidance published by the Internal Revenue Service.
