§ 36.03 MEMBERSHIP.
   (A)   (1)   The membership of the retirement system shall include the following.
         (a)   All persons who are in the employ of the city on March 31, 1955 and who continue in the employ of the city on or after April 1, 1955;
         (b)   All persons who become officers or employees of the city on and after April 1, 1955; this subdivision shall be subject to division (A)(2) of this section.
      (2)   The membership of the retirement system shall not include the following.
         (a)   Any person whose services to the city are compensated on a fee basis.
         (b)   Any person whose compensation normally averages less than $7,000 per annum.
      (3)   In all cases of doubt as to the membership status of any person, the Board shall decide the issue, and the decision of the Board shall be final and conclusive.

   (B)   Except as otherwise provided in this chapter, should any member leave the employ of the city for any reason except retirement or death, he or she shall cease to be a member, and he or she shall forfeit his or her credited service. In the event the person returns to city service, he or she shall again become a member, and should he or she return within a period of years not greater than the number of years of forfeited city service, his or her forfeited service credit shall be restored to his or her credit, subject to the provisions of § 36.50. In the event a member becomes a retirant or dies, he or she shall thereupon cease to be a member.
