§ 35.01 DEFINITIONS.
   For the purpose of this chapter the following definitions shall apply, unless the context clearly indicates or requires a different meaning.
   BID. A written response to a request by the city for pricing on specific goods or services in a format acceptable to the city.
   BIDDER. Any respondent to a request by the city for goods, services, or contracts in a format acceptable to the city.
   BIDDERS’ LIST. A nonexclusive list maintained by the city of interested vendors which the city shall use to obtain bids for goods, services, and contracts. Vendors who wish to be included on the list shall submit a request to the Purchasing Agent in writing. Vendors who do not respond to any city bid request may be removed from the BIDDERS’ LIST.
   BULLETIN BOARD. A board located in the Civic Center accessible to the public during normal hours of operation on which notice of public interest may be posted.
   CITY-BASED BUSINESS. A business that is located within the City of Garden City and that has made payment of all required property taxes on real and personal property for at least one fiscal year, and that is compliant with all permitting, licensing and other ordinance requirements.
   CITY PROJECT. Any new construction, alteration, repair, installation, painting, decorating, completing, demolition, conditioning, reconditioning, or improvement of public buildings, works or roads authorized by a contracting agent as defined herein and which costs or is estimated to cost in excess of $20,000.
   CONSTRUCTIVE MECHANIC. A skilled or unskilled mechanic, laborer, worker, helper, assistant, or apprentice working on a city project, but shall not include executive, administrative, professional, office or custodial employees.
   CONTRACTING AGENT. Any officer, City Council, board or commission of the city, or any institution of the city supported in whole or in part by city funds, authorized to enter into a contract for a city project or to perform a city project by the direct employment of labor.
   DEPOSITS. Monetary funds or surety which, when deemed necessary by the Purchasing Agent, must be accompanied with a bid as a promise to enter into a contract, provide a service or good, or fulfill a bid for sale of city property. Unsuccessful bidders shall be entitled to the return of their deposit or surety. A successful bidder shall forfeit any deposit or surety required upon failing to enter the contract within a time determined by the city.
   FISCAL YEAR. The fiscal year of the city, being July 1 through June 30.
   PURCHASING AGENT. The City Manager or his duly authorized representative shall act as Purchasing Agent of the city. The City Manager shall adopt any necessary rules respecting requisitions and purchase orders pursuant to this Chapter.
   QUOTES. Written or verbal offer to sell or buy at a stated price.
   REQUEST FOR PROPOSAL (RFP). A request for interested parties to submit a bid or proposal to do work for the city and/or businesses or government entities affiliated with the city.
