(A) On June 12, 1830, the Theological Seminary of the Protestant Episcopal Church in the Dioceses of Ohio (“Seminary”) set forth the plat of the “Town of Gambier” as recorded in Deed Volume II, Page 160 of the Deed Records of Knox County, Ohio (the “plat”), but the plat did not identify the real property known as “Middle Path” or dedicate the streets which border Middle Path between Brooklyn Street and Wiggin Street (Exhibit A, set forth in the ordinance codified in this section and incorporated as if set out in full herein).
(B) The current most accurate representation of Middle Path and the streets which border Middle Path between Brooklyn Street and Wiggin Street is provided in the survey and plat entitled “Dedication Plat for Part of Chase Avenue and Gaskin Avenue and Lot Number ___, Village of Gambier” (“dedication plat”) (Exhibit B, set forth in the ordinance codified in this section and incorporated as if set out in full herein).
(C) Kenyon College, successor-in-interest to the Seminary, and the village desires to formalize the identity of Middle Path as real property owned by Kenyon College and to dedicate the streets identified on Exhibit B to public use.
(D) (1) Kenyon College dedicates and grants to the village the streets described and depicted in the dedication plat attached hereto as Exhibit B for public use.
(2) The village accepts and confirms the public streets and alleys as set forth in Exhibit B in accordance with R.C. § 723.03.
(E) Kenyon College hereby grants an easement to the village for the sole purpose of operating and maintaining the utilities now in existence on the land constituting Middle Path.
