§ 51.99 PENALTY.

   (A)   Any person violating any provision of this chapter, for which no other penalty is provided, shall be subject to the penalty provisions of § 10.99.

   (B)   Violations of § 51.02 shall be punishable by a fine not to exceed $500. Each day that such person continues to operate any such water well which has been installed in violation of the terms of § 51.02 is deemed to be a continuing and separate violation.

   (C)   (1)   Any invoice described in § 51.03 unpaid by the fifteenth day of the month following the distribution of a past due invoice reminder is subject to the following penalties:

         (a)   Water: 10% of the first $3 and 3% of the balance;

         (b)   Wastewater: 10% of the balance;

         (c)   Sanitation: 10% of the balance; and

         (d)   Stormwater: 10% of the balance.

      (2)   Penalties are applied the sixteenth day of each month.

      (3)   Failure to make payments as required, including late charges, may result in legal collection efforts including lawsuit and liens upon real property as permitted by applicable law.

      (4)   The following penalties will be applied for any waterworks service required:

         (a)   Voluntary service shut off: $3;

         (b)   Voluntary service turn-on: $3; and

         (c)   Reconnect fee: $40.

   (D)   Any user who violates §§ 51.19 or 51.20 may be punished by a fine of not more than $2,500 (see I.C. 36-1-3-8(a)(10)(B)). Each day of violation shall constitute a separate offense. In addition to, or in the alternative to, a fine, water service may be terminated for any user who violates §§ 51.18 or 51.19.
