§ 94.03 ENCUMBRANCE OF STREETS, ALLEYS, AND OTHER PUBLIC WAYS.
   (A)   It shall be unlawful for any person, persons, or corporation to encumber or obstruct any one of the streets, alleys, or other public grounds of the town, or any part of any street, alley, or other public grounds of said town, with any vehicle, engine, or other machinery, substance, or material of any kind whatsoever, or excavation interfering with the free use of the same or to encumber any of the streets, alleys, and other public grounds of the town, by depositing thereon, or by depositing on any part of any street, alley, or other public grounds of the town any quantity of petroleum, naptha, benzine, gasoline, crude oil, and its products and other inflammable explosives, and burning oils and fluids, powder, or dynamite, without first procuring a permit from the Town Council to do so; providing that nothing in this section shall be construed to apply to merchandise, wood, coal, or other material temporarily placed not exceeding five hours on the said street, alley, and other public grounds for the purpose of being loaded or while being unloaded.
   (B)   Any person desiring to encumber or obstruct any street, alley, and other public grounds of the town or any part of any street, alley, and other public grounds of the town as defined in division (A) above shall first show to the Council members of the town the necessity for such encumbrance or obstruction of the street, alley, and other public grounds of the town or any part of any street, alley, and other public grounds of the town to be so encumbered or obstructed. Where a reasonable necessity exists for such encumbrance or obstruction, it shall be the duty of the Council member to grant permission therefor provided, that any such person, persons, or corporation obtaining such permission to obstruct or encumber said street, alley, and other public grounds of the town, or any part of any street, alley, and other public grounds of the town, shall first indemnify the town against any damage of any kind whatsoever accruing therefrom in any sum to be designated by the Town Council.
   (C)   Where permission is granted by the town as provided for in division (B) above to any person, persons, or corporation to encumber or obstruct any street, alley, and other public grounds of the town, or any part of any street, alley, and other public grounds of the town, it shall be the duty of such person, persons, or corporation to fence or otherwise enclose such part of parts of any street, alley, and other public grounds of the town, or such parts of any street, alley, or other public grounds of the town, so encumbered or obstructed. It shall be the duty of any person, persons, or corporation so encumbering or obstructing any street, alley, and other public grounds of the town, or any part of the any street, alley, and other public grounds of the town, to cause one or more red lights to be securely and conspicuously posted at or upon any excavation or obstruction, stationing one of such lights at each end of the space so encumbered or obstructed. If such space exceeds 50 feet in length or breadth, such person shall place additional lights at intervals of 50 feet or less, and such persons, persons, or corporation shall maintain and continue the burning of the aforesaid lights from dark in the evening until daylight next morning, during each night such excavation or obstruction shall be allowed to remain.
   (D)   It shall be unlawful for any person or persons to ride or drive any motorcycle, bicycle, or other vehicle or animal on any cement sidewalk within the corporate limits of the town except in the necessary act of crossing the same.
