(A) Restrictions on use and type of fireworks.
(1) The use of fireworks, consumer or commercial, which produce bangs and/or pops and/or whistles in excess of normal fire burning or sparks, excepting therefrom sparklers, snap-pops, and party poppers, within the town limits shall be limited and restricted as follows:
(a) Between the hours of 10:00 a.m. and 11:00 p.m. on July 1 through July 7;
(b) Between the hours of 10:00 a.m. and 12:00 a.m. on Memorial Day, July 4, and Labor Day;
(c) Between the hours of 10:00 a.m. and 1:00 a.m. on December 31; and
(d) Any other time authorized by the Town Council in writing.
(2) Nothing in this section shall prohibit the local Fire Chief, State Fire Marshal, the Town Marshal, or any duly authorized law enforcement official from further restricting or prohibiting the use of fireworks during the aforementioned periods of time for any weather related or public safety reasons.
(B) Restrictions on locations for use of fireworks. The use of any fireworks shall be restricted to the property owned and or leased by citizens of the town and their guests. Fireworks shall not be used on any public property of the town, including but not limited to, public streets, public sidewalks, alleys, parks, or public rights-of-way. Any person discharging any firework, whether during authorized time periods or not, shall be responsible for any and all damages or injuries which may result from the use of those fireworks.
