(A) The fire limits of the town shall consist of that part of the town bounded as follows: beginning at the intersection of Howard and Main Streets, thence running due north to the intersection of North and Main Streets, thence due east to the intersection of North and Deer Creek Streets, thence due south to the center of Howard Street, thence due west to the point of beginning and it shall not be lawful for any person to erect, move, or build any or frame building within such limits, except as may be provided by this section.
(B) Within the fire limits of said town as set out in division (A) above, it shall be unlawful for any person or persons to locate, build, or move any building or whatever character or addition unless all the outer walls are constructed of brick, stone or concrete, metal, gravel, tile or slate roof and with a fire wall of not less than 12 inches in thickness of brick, stone or concrete, extending and through the roof the entire length of the building on lines between adjoining properties whenever buildings touch or are joined together except as hereinafter provided.
(C) Any person desiring to erect any wooden out building on the rear end of a lot which said outbuildings are to be appurtenances to the property on said lot within the limits prescribed in division (A) above shall present a petition to the Council members describing the place of construction and the purpose for which such use is to be used when constructed and a complete diagram of the building of the contiguous lots, upon which the Council members may grant to erect such building, when such building is completed, it must things conform to the averments of said petition, provided that this section shall not apply to the building of residence property on within the said fire limit which are now occupied by residence but which may become vacant after the passage of this section.
