§ 33.021 DUTIES AND POWERS.
   The Commission’s duties and powers shall include the following:
   (A)   Review and analyze the city’s Building Code, Electrical Code, Fire Prevention Code, Heating Code, Housing Code and Plumbing Code and recommend to the City Council any change or revision that the Commission believes should be made in any code;
   (B)   Recommend to the City Council interpretation of vague areas of any code and analyze and recommend to the City Council clarifications thereof;
   (C)   Review new products and methods not covered under the codes and make recommendations to the City Council as to the acceptability of the product or method;
   (D)   Hear and act upon requests for variances of the codes, provided that any action taken may be appealed to the City Council. The procedure for making an appeal is as follows:
      (1)   A written notice of appeal must be filed with the Community Development Department within 15 days following the action complained of; and
      (2)   The appeal shall be considered by the City Council at its next regularly scheduled meeting occurring not less than five days following the filing of the notice of appeal. The City Council may, in its discretion, uphold, overturn or amend the action taken by the Commission.
   (E)   Review cases in which contractors fail to correct violations in their work and make recommendations to the City Council on whether to invoke the contractor’s bond.
