§ 151.073 APPEALS.
   (A)   Where the Commission has denied issuance of a certificate of appropriateness, the applicant for the certificate may appeal to the City Council. The appeal must be filed with the City Clerk within 15 days after the decision of the Commission. The City Council shall hold a public hearing and shall vote on the appeal within 45 days of its receipt.
   (B)   A simple majority vote of the City Council in opposition to the denial must be recorded in order for a denial by the Landmark Commission to be overturned.
   (C)   A simple majority vote of the City Council in support of the denial must be recorded in order for a denial by the Landmark Commission to stand. The City Council shall transmit its decision in writing to the Building Inspector and the applicant.
