It shall not be considered a violation of this subchapter for persons under the age of 21 to purchase or possess tobacco products, electronic cigarettes or alternative tobacco when participating in a program for monitoring compliance with this subchapter conducted by local law enforcement agencies, as long as those persons are supervised by the personnel of the local law enforcement agencies, and the consent of a parent or guardian is obtained.
