§ 110.020 GENERALLY.
   (A)   A permit for circuses, carnivals, menageries or traveling shows of similar nature shall be required for each day on which a performance, show or exhibition is held. The charge for the permit shall be $150 per day; provided, however, that if the applicant for the permit is a not-for-profit corporation as defined in § 113.001, then and in that event the charge for the permit shall be $50 per day. It is further provided that the charge for the permit shall be $100 per day for those performances, shows or exhibitions held on the premises of a local business establishment which sponsors the circus, carnival, menagerie or traveling show for the purpose of promoting the business of the local establishment.
   (B)   A permit authorizing circuses, carnivals or traveling shows of similar nature to conduct a performance, show or exhibition as hereinbefore mentioned shall be issued by the City Clerk upon proper application being made therefor and the payment of the permit fee as hereinbefore set forth.
   (C)   The continuance in effect of the permit to operate the shows shall be contingent upon the condition that there shall not be set up or operated any gambling device, lottery, number or paddle wheel, number board, punchboard or other game of chance, or any lewd, lascivious or indecent show or attraction making an indecent exposure of the person or suggesting lewdness. Any law enforcement officer having jurisdiction in the city shall have the right to enter upon any and all portions of the premises used by the shows for the purpose of investigating the possibility of the aforesaid activities and any other activities of potentially unsavory nature.
