§ 97.129 EXCAVATIONS BARRED IN NEW STREET IMPROVEMENTS.
   (A)   Whenever the City Council enacts any ordinance or resolution providing for the paving, repaving or resurfacing of any street, the City Engineer shall promptly mail a written notice thereof to each person owning any utility lines in or under the street. The notice shall notify the persons that no excavation shall be permitted for openings, cuts or excavations in the street for a period of five years after the date of enactment of the ordinance or resolution.
   (B)   Within the 45 days every public utility company receiving notice as prescribed herein shall perform the excavation work, as may be necessary to install or repair mains, conduits or other utility installations. During the five-year period no excavation shall be permitted to open, cut or excavate in the street unless in the judgment of the City Engineer an emergency exists which makes it absolutely essential that the excavation permit be used.
