§ 97.125 CITY’S RIGHT TO RESTORE SURFACE.
   (A)   If the permittee shall have failed to restore the surface of the street, sidewalk, driveway or curb or gutter to its original and proper condition upon the expiration of a reasonable time of not to exceed 14 calendar days after completion of excavation work, the City Engineer, if he or she deems it advisable, shall have the right to authorize all work and things necessary to restore the street, sidewalk, driveway, curb or gutter and to complete the excavation work. The permittee shall be liable for the actual cost thereof and 10% of the cost in addition for general overhead and administrative expenses.
   (B)   It shall be the duty of the permittee to guarantee and maintain the site of the excavation work in the same condition it was prior to the excavation for one year after restoring it to its original condition.
