§ 97.124 RESTORATION OF SURFACE.
   (A)   The permittee shall restore the surface of all streets, sidewalks, driveways, curbs and gutters broken into or damaged as a result of the excavation work to its original condition and/or in accordance with the specifications of the City Engineer and any other applicable regulation, code or ordinance. The permittee may be required to place a temporary surface over openings made in paved traffic lanes. Except when the pavement is to be replaced before the opening of the cut to traffic, the fill above the bottom of the paving slab shall be made with suitable material well tamped into place, and this fill shall be topped with a minimum of at least two inches of crushed rock which is suitable to maintain the opening in good condition until permanent restoration can be made. The crown of the temporary restoration shall not exceed one inch above the adjoining pavement. The permittee shall exercise special care in making the temporary restorations and must maintain the restorations in safe traveling condition until such time as permanent restorations are made. If the temporary restorations are not maintained, and after due notification, the City Engineer may direct the work to be done and the cost thereof charged to the permittee.
   (B)   Permanent restoration of the street, sidewalk, driveway, curb and gutter shall be made by the permittee in strict accordance with the specifications prescribed by the City Engineer for the restoration for the purpose of restoring the same to its original condition, as nearly as possible. Any permanent restoration shall be made so that brick shall be replaced with materials meeting the requirements of the current city statement of policy regarding brick streets in the city on file in the office of the City Clerk, concrete shall be replaced with concrete, bituminous concrete shall be replaced with bituminous concrete, and oiled earth shall be replaced with oiled earth or bituminous concrete.
   (C)   All work shall be done in a workmanlike manner, and concrete shall be treated and allowed to cure in accordance with accepted good practice and a “crushed stone concrete” shall be used in all cases where concrete is specified. All bituminous concrete shall be placed on the exact same type base as was originally in place, or a substitute deemed satisfactory by the engineer, and shall be rolled with a pneumatic-tired roller or steel roller as directed by the engineer. Oiled earth shall have a satisfactory granular base comparable to the original, or one deemed satisfactory by the Engineer and shall be primed and sealed in a manner directed by the Engineer.
   (D)   Acceptance or approval of any excavation work shall not prevent the city from asserting a claim against the permittee for incomplete or defective work if discovered within 24 months from the completion of the excavation work. The City Engineer’s presence during the completion of any excavation work shall not relieve the permittee of its responsibilities hereunder.
