(A) Promotional sampling is the delivery, without costs, of not more than one sample, consisting of not more than one ounce, of an alcoholic liquor for promotional or advertising purposes to any person, other than a minor.
(B) The holder of a Class C liquor license may conduct promotional sampling of an alcoholic liquor product, provided that:
(1) Notification, in writing, of the promotional sampling is made to the office of the City Clerk at least five days prior to the promotion; and
(2) The promotion is conducted during a specific period of time, not to exceed 16 hours.
(C) No Class C liquor licensee nor any agent or employee of the Class C license holder shall deliver more than one promotional sample to the same person during a 24-hour period.
(D) No more than 36 promotional samplings shall be conducted by the same Class C license holder, his or her agent or employee, during a calendar year.
(E) The promotion will remain within the licensed premises as specified in the original license application.
(F) The promotion will not conflict with or otherwise violate this chapter or any other ordinance of the city.
