§ 51.010 WATER SERVICE LINE BREAKS.
   (A)   Whenever a leak shall occur, within the limits of a public street, public alley or other public right-of-way, in a water line (other than a lead pipe water line), connecting a water user’s premises to a water main, or in the connection of the water line with the water main, the city shall, at its own expense, perform or cause to be performed those of the following items of work as shall be necessary to effect a repair of such service line: cutting of surface of each public right-of-way; erection and maintenance of barricades; excavation; backfilling of excavation; removal of all surplus materials; and replacing of surface.
   (B)   Whenever a leak in a lead pipe water service line connecting a water user’s premises to a water main, regardless of whether the leak shall occur within, under or upon public or private property, it shall be the responsibility of the owner of the water service line, and the owner shall be required to furnish the labor and material to replace the lead pipe water service line with a plastic or copper service line; provided, however, that the city shall at its own expense perform or cause to be performed any of the following items of work as shall be necessary to effect a replacement of the lead pipe water service line: excavation of the line from the water meter to the main; backfilling of excavation; replacing of surface.
   (C)   If a curb stop is damaged by a city employee turning the curb stop off or on the city shall, at its own expense, perform or cause to be performed any of the following items of work as shall be necessary to effect a replacement of the curb stop: excavation of the curb stop; backfilling; replacing of surface; furnishing a new curb stop and curb box. It shall be the responsibility of the owner of the curb stop and the owner shall be required to furnish the labor and additional materials to replace the curb stop.
   (D)   If a curb stop is damaged by a city employee while turning the curb stop off or on and the water service is a lead pipe water service line, the city shall at its own expense perform or cause to be performed all items as described in division (C) above and the lead service line shall be replaced under the terms and conditions as cited in division (B) above.
