§ 91.03 ANIMALS EXCLUDED FROM PROHIBITION.
   (A)   Animals excluded from prohibition are:
      (1)   Domestic dogs, except those hybridized with wild canines, subject to § 154.406(H)(4) of the City of Galena Zoning Ordinance.
      (2)   Domestic cats, except those hybridized with wild felines, subject to § 154.406(H)(4) of the City of Galena Zoning Ordinance.
      (3)   Domesticated horses and other similar animals, subject to § 154.406(H)(7) of the City of Galena Zoning Ordinance.
      (4)   Domesticated rodents.
      (5)   Domesticated European ferrets.
      (6)   Rabbits, except that an owner may have no more than three rabbits in a residentially-zoned district.
      (7)   Birds, except for species protected by state or federal law, except that an owner may have no more than three chickens in a residentially-zoned district, and except that an owner may have no more than three ducks in a residentially-zoned district.
      (8)   Non-venomous snakes less than eight feet in length, except that such snakes shall be required to be maintained on the owner's premises or property.
      (9)   Non-venomous lizards.
      (10)   Turtles, except for species protected by state or federal law.
      (11)   Amphibians.
      (12)   Fish.
      (13)   Invertebrates.
      (14)   Any animal under treatment or observation by a veterinary clinic operated by a licensed veterinarian.
      (15)   Any animal in the ownership of a person temporarily transporting such animal through the city.
      (16)   Any animal in the ownership of a bona fide medical institution or accredited educational institution.
      (17)   Any animal temporarily owned by a facility licensed by the Jo Daviess County Health Department or humane society for the purpose of impounding, sheltering, or caring for animals.
      (18)   Those animals referenced in § 154.406(B) of the City of Galena Zoning Ordinance regarding raising of animals in Agricultural Districts.
   (B)   Upon request of the city, the court may order the confiscation of a prohibited animal if the animal poses an immediate danger to the public or itself. Upon the conviction of a person for owning an animal as prohibited by this chapter, the court shall order the animal confiscated and transferred to an appropriate licensed animal rehabilitation or care facility or the court may order the release of the animal to the owner provided that the animal will not be kept within the city limits.
