§ 119.04 ANNUAL LICENSE AND FEES.
   All licenses pertaining to this chapter shall be valid for a period of not greater than one year, and shall expire at midnight on the 30th day of April of each year.
   (A)   Horse drawn carriage business license. A license allowing a person, firm, corporation or other entity to operate a horse drawn carriage business as defined in this chapter.
      (1)   Annual license fee; duration of licenses. The annual license fee for each carriage operator shall be $150, and shall be valid from May 1 through midnight of April 30th of the following year.
      (2)   Non-exclusive license. There shall be no more than two carriage operator licenses issued and outstanding at any time.
      (3)   Limitation on transfer of license. The licensee shall not sell, assign, transfer or convey their license without the approval of the City Council.
      (4)   Limitation on number of carriages per license. A license to operate a horse drawn carriage business shall enable the licensee to operate up to two carriages at any given point in time on the approved routes, but shall not limit the total number of carriages owned or leased by the licensee.
   (B)   Nontransferability; compliance with state law. No license issued under this chapter shall be transferable or assignable to entities other than the business owners specifically listed on the license application. All businesses shall comply with the State of Illinois Assumed Business Name Act, and all other state laws pertaining the name and operation of the business, partnership, or corporation.
   (C)   Issuance priority. Annually, prior year licensees shall be granted renewal of their license before application of new licenses are considered; provided that the existing license is otherwise in compliance with this chapter and entitled to a license. No individual or legal entity shall be entitled to more than one such license. Provided that there are additional licenses available after issuance of a license to prior year licensees, then applicants for new licenses shall be reviewed in the order they are received.
