For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
ALCOHOL. The product of distillation of any fermented liquid, whether rectified or diluted and includes synthetic ethyl alcohol. It does not include denatured alcohol or wood alcohol.
ALCOHOLIC LIQUOR. Any spirits, wine, beer, ale or other liquid containing more than 0.5% of alcohol by volume, which is fit for beverage purposes.
BED AND BREAKFAST, SMALL INN, and GUEST LODGE. Any duly licensed lodging establishment as defined in § 154.015 of this Code of Ordinances.
BEER or ALE. A fermented alcoholic grain, barley, or malt beverage less than 10% alcohol by weight.
BREWPUB. A micro-brewery that sells at retail some portion of its production for off-premises consumption.
BOWLING ALLEYS. Any establishment or building, or any part thereof, wherein the game of bowling played with composition balls and ten wooden pins is played.
CLUB. A corporation organized under the laws of this state, not for pecuniary profit, solely for the promotion of some common object other than the sale and consumption of alcoholic liquors, which conforms to the definitions of a club in ILCS Ch. 235, Act 5, § 1.
CONVENTION CENTER. A public place kept, used, maintained, advertised and held out to the public as a place where meetings, gatherings, receptions, conventions and special events are held.
DELICATESSEN. Any public place kept, used, maintained, advertised and held out to the public as a place where freshly prepared foods are available ready for serving and where the principal business is the purchase and carrying out of said freshly prepared foods; provided however, that such delicatessen may include as an incidental part of its business the serving of such freshly prepared foods for consumption on the premises. In no event shall the principal business of a delicatessen be the sale of alcoholic beverages.
DISTILLER. A person who distills, ferments, brews, makes, mixes, concocts, processes, blends, bottles or fills an original package with any alcoholic liquor. A DISTILLER may makes sales and deliveries of alcoholic liquor to distillers, rectifiers, importing distributors, distributors, and non-beverage users and to no other licensees.
HOTEL. Every building or other structure kept, used, maintained, advertised and held out to the public as a place where meals are actually and regularly served and sleeping accommodations are offered for adequate pay to the guest, whether transient, permanent or residential in which 25 or more rooms are used for sleeping accommodations and dining rooms being conducted in the same building or buildings, structure or structures being provided with adequate and sanitary kitchen and dining room equipment and capacity, and where the principal business is the operation of a hotel and restaurant.
MICRO-BREWERY. A brewery producing not more than 100,000 gallons of beer per year and shall be considered a manufacturing operation.
RESTAURANT. Any public place kept, used, maintained, advertised and held out to the public as a place where meals are served, and where meals actually are served and regularly served, without sleeping accommodations and where the principal business is the serving of meals and not the sale of alcoholic beverages, and such space being provided with adequate and sanitary kitchen and dining room equipment and capacity and having employed therein a sufficient number and kind of employees to prepare, cook and serve suitable food for its guests.
RETAIL SALE. The sale for use of or consumption and not for resale.
SALON/DAY SPA. Any business establishment devoted to the cutting, washing, dyeing and/or styling of hair, and also including the cosmetic treatment of skin and of fingernails and toenails.
WINE. Any alcoholic beverage obtained by the fermentation of the natural contents of fruits, or vegetables, containing sugar, including such beverages when fortified by the addition of alcohol or spirits. (ILCS Ch. 235, Act 5, § 1-3.03)
