§ 110.02 DEFINITIONS.
   For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   CARNIVAL. A collection of rides, games, and amusement shows, for which admission is charged or individual events are charged for.
   CIRCUS. A traveling show in which wild animals, athletic feats, clowns, etc., are exhibited, usually under a large tent.
   COIN-OPERATED DEVICE. A device which provides a service, entertains, or dispenses a physical product or good upon receipt of coins or other tokens.
   CONVENTION CENTER. Any building, auditorium, or portion of a building (except those owned by a governmental entity) licensed leased or used for short periods of time of up to 14 days, for conventions, expositions, meetings, receptions, exhibitions, athletic contests, carnivals, rentals to itinerant merchants or itinerant vendors, or similar uses.
   DOOR-TO-DOOR SOLICITOR OR COMMUNICATOR. Any person who is engaged in the contact with citizens for the purpose of religious, political, charitable, patriotic or philanthropic motivations or other similar solicitation or communication from door-to-door, house-to-house, place-to-place, or street-to-street.
   EXPOSITION. A large public exhibition, show or display, including (but not limited to) displays of art, industrial or commercial products, services or recreational equipment, at which no sales of or orders for any of the displayed merchandise are made.
   FAIR. A gathering for competition, or exhibition of various products, often with amusements and educational displays.
   FARMERS' MARKET. A group of vendors collected at a location approved by the City Council for selling only home-grown products, food items, or handmade products consistent with Jo Daviess County Health Department regulations.
   FESTIVAL. A collection of games, activities, sales booths, etc. See also FLEA MARKET and/or FUNDRAISING EVENT.
   FIREARMS, WEAPONS OR MUNITIONS DEALER. Firearms, weapons or munitions dealers shall be subject to all statutes and regulations enacted by the State of Illinois.
   FLEA MARKET. Any location other than a permanent retail store at which space is rented or otherwise made available to others to conduct business as transient merchants, itinerant vendors, hawkers, peddlers or similar sales or transactions for a period of not more than 48 consecutive hours.
   FUNDRAISING EVENT. An event in which all proceeds are used to benefit a NONPROFIT ORGANIZATION as defined below.
   GARAGE SALE. A private individual or group of individuals gathered at one private residential property for the sale of assorted household goods within a period of not more than 72 consecutive hours.
   ITINERANT MERCHANT. Any person who is engaged temporarily in the sale of goods, wares or merchandise, either new or used, who, for the purpose of conducting such business, occupies or uses any convention center or any other location within the municipal limits for periods of fewer than five days at a single location to display or sell such goods. Exceptions to this are individuals conducting not more than two garage sales per year on private residential property.
   ITINERANT VENDOR. Any person who transports tangible personal property for display or sale at a convention center or any other location within the municipal limits, but who does not maintain an established office, distribution house, sales house, warehouse, service center or residence from which the business is conducted.
   JUNK. Old metal, glass, paper, rags, parts and similar items that may be salvageable for reuse or resale.
   LUNCH STAND. Any temporary set-up, excluding mobile food trucks, outside of a permanent building for the purpose of serving food and/or liquid refreshments to the general public.
   MENAGERIE. A collection of wild and/or dangerous animals for exhibition, for which admission is charged.
   MOBILE FOOD TRUCK. A motorized vehicle or a towed trailer that is equipped with facilities for cooking, preparing, and selling food.
   NONPROFIT ORGANIZATION. An organization which is legally chartered as nonprofit, and charitable or educational in nature.
   PAWNBROKER. A person who loans money on deposit or pledge of personal property or other valuable, or to deal in the purchase of personal property or other valuable thing on conditions of selling same back at a stipulated price.
   PEDDLER. Any person soliciting, delivering or canvassing for the sale of goods, wares, products or services from house to house, place to place or street to street, except those persons participating in duly recognized fund raising events, including but not limited to, religious, charitable, patriotic, or philanthropic events defined above. This definition shall not apply to persons making regular sales or deliveries, on established routes throughout the year.
   STREET PERFORMER. A person engaging in a performance that includes, but is not limited to, the following activities: playing musical instruments, singing, dancing, acting, pantomiming, puppeteering, juggling, reciting, or creating visual art in its entirety as a performance.
   VENDOR. See ITINERANT VENDOR.
