§ 36.23 SICK LEAVE.
   Sick leave with pay shall be granted to all probationary and permanent employees at the rate of one working day for each calendar month of full time service or major fraction thereof, except that sick leave granted probationary employees shall not be available for use until satisfactory completion of the initial (not promotional) probationary period.
   (A)   Sick leave may be granted only for absence from duty because of personal illness, legal quarantine or death or serious illness in the immediate family. Sick leave shall be computed on a calendar year basis and may be accumulated to a total of not more than 90 days. Workers' compensation benefits received shall be credited against the compensation due an employee during sick leave, but no additional sick leave shall be given because of such workers' compensation benefits.
   (B)   In order to be eligible for sick leave with pay, an employee must:
      (1)   Report promptly to his department head the reason for his absence.
      (2)   Keep his department head informed of his condition if the absence is of more than three days' duration.
      (3)   Submit a medical certificate for any absence of more than three days if required by the Mayor or department head.
   (C)   Claiming sick leave when physically fit, except as permitted in this section, may be cause of disciplinary action, including transfer, suspension, demotion or dismissal.
   (D)   Upon an honorable separation from employment, employees shall be paid as terminal pay one-third of their accumulated sick leave.
   (E)   In all cases sick leave must be earned and charged in at least one-half day increments.
   (F)   The Mayor shall determine whether a person shall be allowed to receive a deficit of sick leave except that in no case can more than one year's sick leave be used in advance without Council approval.
   (G)   Bereavement leave. An employee shall be granted three days leave of absence at full pay in the event of a death in his/her immediate family. IMMEDIATE FAMILY is defined as a spouse, a parent, children, a sister, a brother, a grandparent, grandparent-in-law, a mother-in-law, a father-in-law, a sister-in-law , a brother-in-law and stepchildren.
   (H)   Personal leave. An employee may convert two sick days into two personal days each year if no sick days have been taken by that employee in the previous fiscal year. Unused personal days up to a maximum of two days may be carried over from year to year. No vacation days or compensatory time may be used by employees in lieu of sick days to bypass this criteria.
   (I)   Health insurance for retired employees. All retired employees shall be entitled to insurance benefits up until the time that said employee qualifies for Medicare. This provision shall be contingent on the retired employee paying 100% of the insurance premium costs.
