§ 91.02 PLANTS AND WEEDS.
   (A)   Nuisance weeds. Any weeds such as jimson, burdock, ragweed, thistle, cockleburr or any other weeds of like kind found growing in any lot or tract of land in the city are a nuisance, and it is unlawful to permit any such weeds to grow or remain in any such place.

   (B)   Weeds, grass or plants; height restrictions. It is unlawful to permit any weeds, grass or plants other than trees, bushes, flowers or other ornamental plants to grow to a height exceeding eight inches anywhere within the city, any such plants exceeding such height are a nuisance.

   (C)   Abatement procedure. 
      (1)   It is the duty of the health officer to serve or cause to be served a notice upon the owner or occupant of any premises on which weeds or plants are permitted to grow in violation of the provisions of this section and to demand the abatement of such nuisances within ten days.
      (2)   If such person does not proceed to abate such nuisance within ten days, the health officer shall proceed to abate such nuisance, keeping an account of the expenses of such abatement, and such expense shall be charged to and paid by such owner or occupant.

   (D)   Exceptions. Notwithstanding anything to the contrary in this section or any other section of this Code, a committee comprised of the Public Works Director, City Administrator and one Alderman to be appointed by the Mayor to serve for the time set forth in the motion, may determine in their sole discretion by majority vote, to grant an exception for certain areas of the city to the requirements of this section. Any exceptions granted by a majority vote of the committee shall be set forth in writing with sufficient clarity to identify the location of the excepted area and all terms and conditions of the exception as may be determined at the sole discretion of the committee. A copy of the written exception shall be provided to the owner or owners of the real estate included in the exception and shall be available at City Hall for inspection by the general public. The City Council may by majority vote, reverse a decision of the committee to grant or deny an exception under this section.
