§ 10-1 ENFORCEMENT BY OFFICE OF CODE ENFORCEMENT
   (A)   Enforcement of building codes and ordinances shall be the responsibility of the City Code Enforcement Officer and/or the Police Department and/or Fire Department.
   (B)   There is hereby created and established in the Office of Code Enforcement a position designated and titled as Code Enforcement Officer subject to the following:
      (1)   This position shall be appointed by the City Commission pursuant to KRS 83A.080;
      (2)   The term of this position shall be continuous except upon removal by the City Commission upon which the City Commission shall give the Code Enforcement Office a written statement setting forth the reason or reasons for the removal. However, this requirement shall not be construed as limiting in any way the at-will dismissal power of the City Commission;
      (3)   The oath of officer shall be commissioned upon and executed by the Code Enforcement Officer as set forth in § 228 of the Constitution of the Commonwealth of Kentucky;
      (4)   The duties of the Code Enforcement Officer shall be enforcement of codes as outlined by ordinances herein and other duties as may be assigned by the City Manager or as otherwise delineated herein;
      (5)   The duties of the Code Enforcement Officer shall have all powers of a citation officer as described in KRS 83A.087; and
      (6)   The Code Enforcement Officer shall be appointed in the capacity of an independent contractor or employee of the city as the City Commission determines, in their absolute discretion.
