§ 49-1 DEFINITIONS.
   For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   MOBILE FOOD ADMINISTRATOR. The City Manager or his or her designee.
   MOBILE FOOD CART. An unmotorized wheeled device meant to be pushed along the sidewalk, or stationary in one location, for the sale of both prepared and pre-packaged foods and/or beverages.
   MOBILE FOOD OCCUPATIONAL LICENSE. All mobile food vendors must apply and receive a city occupational license from the City Clerk prior to vending within the city.
   MOBILE FOOD VEHICLE. A vehicle-mounted, vehicle-towed or vehicle-carried food service establishment that engages in the sale of both prepared and pre-packaged foods and/or beverages.
   MOBILE FOOD VENDOR. A person or persons that prepare or serve food and/or beverages to the general public from a mobile food vehicle or mobile food cart.
   TEMPORARY OR TRANSIENT BUSINESS. Any business conducted for the sale or offer for sale of goods, wares or merchandise, including off-site car sales, which is carried on in any building, structure, motor vehicle or on real estate in one locality for a period of less than six continuous, uninterrupted months in each year.
   TRANSIENT MERCHANT. Any firm, person, corporation, partnership or other entity which engages in, does or transacts any temporary or transient business in the city either in one locality or in traveling from place to place in the city offering for sale or selling goods, wares, merchandise or commodities or any kind, and including those merchants who hire, lease, use or occupy any building, structure, motor vehicle or real estate, including off-site car sales.
