§ 40-1 DEPARTMENT OF SANITATION.
   (A)   There is hereby established a department of city government to be known as the Department of Sanitation.
   (B)   The Department of Sanitation is to be headed by a Superintendent who shall be appointed by the Board of Commissioners upon the recommendation of the City Manager. The Superintendent shall have control and supervision over all employees assigned to this Department subject to the supervision of the Board of Commissioners for the city. Further, the Superintendent of the Department of Sanitation shall:
      (1)   From time to time as requested, submit recommendations to the Board of Commissioners for its approval and adoption as to reasonable and fair rates to be charged for the collection of garbage and refuse, including the establishment of special rates in those cases where it appears necessary;
      (2)   From time to time or as requested, submit recommendations to the Board of Commissioners for its approval as to the adoption of rules and regulations including penalties for violation thereof, for the collection of garbage and refuse;
      (3)   Assist in the enforcement of all laws and ordinances enacted in the city relating to the handling of garbage and refuse and the collection of the garbage and refuse from all premises within the city;
      (4)   Develop plans for improvements and economies in the operation of the Sanitation Department and recommend the adoption and approval of the improvements and economies to the Board of Commissioners;
      (5)   Coordinate, maintain, operate and supervise the handling and collection of garbage and refuse;
      (6)   Prepare costs and cost statistics as are required from time to time by the Board of Commissioners; and
      (7)   Contract with appropriate refuse and garbage disposal businesses for these purposes.
