7.16.010   Hypnotism.
   A.    No person shall, by any statement, suggestion, or command, or by any other act, place any other person in, or induce or cause any other person to experience or to enter into, any state or condition, real, pretended, imagined or artificial, of sleep, suspension of pain or other sensation, suspension of will of such person, muscular rigidity, fixity of posture, loss of contact with environment or delirium, or to be subject or obedient to his will or commands, or to experience, or be in, or enter into, any state or condition substantially similar to a state or condition produced by, resulting from, or known as hypnosis, artificial catalepsy, somnambulism, or mesmerism.
   B.    The provisions of this section shall not apply to any of such acts when done by, or under the direction of, a person licensed under the laws of the State of California to practice psychiatry, as an aid to the physical, mental or emotional welfare of any person, subjected thereto, or as an aid to the discovery of unknown facts under investigation by any law enforcement agency, governmental body or legal representative of such person.
   Nothing in this section shall be considered to prohibit qualified members of the recognized professional groups from utilizing hypnotic techniques as provided by Section 2908 of the California Business and Professional Code, nor shall the provisions of this section apply to any such acts when done at an establishment licensed pursuant to Chapter 3.08 of this code pertaining to live entertainment.
