§ 150.16 BUILDING AND ZONING FEE SCHEDULE.
   The city, pursuant to the Zoning Ordinance, hereby establishes, for the necessary zoning and building permit applications, alteration, demolition and occupancy permits, and for zoning review and appeal, the following schedule of fees:
   (A)   Zoning permit applications.
      (1)   All uses, whether new construction or additions to existing construction - $20.00 plus $0.01 per square foot.
      (2)   Change in use when the zoning classification and building dimensions are not changed - $20.00.
      (3)   Signs and other accessory uses (excluding fences and parking as regulated by divisions (4) and (5) below) - $20.00 per sign.
      (4)   Fences - $20.00.
      (5)   Off-street parking and loading or unloading area when developed separately and not included in division (A) above - $20.00 plus $0.50 per parking space and loading/unloading space.
   (B)   Certificate of occupancy permit.
      (1)   For certification of lawful nonconforming uses and structures - $75.00.
      (2)   For change in use - no fee (fee included as part of zoning permit).
      (3)   For new construction - no fee (fee included as part of building and zoning permits).
   (C)   Move and set permit. Shall be as required by the zoning permit and building permit, and in addition a transport permit shall also be required - $50.00.
   (D)   Demolition permit. The application fee for the demolition of a building or structure shall be as follows:
      (1)   Single- and two-family dwellings - $50.00.
      (2)   Multi-family dwellings, commercial, residential and other nonresidential uses (such as churches, schools) - $100.00.
   (E)   Board of Adjustment hearing. (Conditional use permits, dimensional variances, changes from one nonconforming use to another appeals) - $100. The applicant must also prepay the recording fee to the Kenton County Clerk's office in the event the application is for a variance. The applicant shall be responsible for all expenses related to the processing and review of the application or appeal. In addition to the fee of $100, the applicant must prepay $500 to the city as a bond to cover the expense of the application or appeal. If the cost is less than $500, then the balance will be refunded. If the cost exceeds $500, the Board may withhold a favorable decision to the applicant until the costs are paid in full. The City Zoning Administrator shall have discretion to accept a bond less than $500, if, in his opinion the expenses to the city will not exceed the amount required to be deposited.
   (F)   Amendments to the city's zoning ordinance. The fee for an amendment to the city's zoning ordinance shall be as follows (this is in addition to the fees that are required by the Planning Commission):
      (1)   Text amendments - $50.00.
      (2)   Map amendment (excluding a development plan) - $50.00.
      (3)   Map amendment, including submission of a development plan - $50.00 plus cost of review of development plan according to divisions (A) and (B) above.
   (G)   Building permit applications.
      (1)   All uses (new construction, additions, and change of use) - $25.00 plus $0.09 per square foot of gross floor area. Gross floor area shall be measured to outside faces of exterior walls and shall be inclusive of living areas, garages, basements, storage areas, sales and display areas, and the like.
      (2)   All uses (remodeling): Where any structural modifications are made to the building, changes to the electrical, plumbing, heating, or other mechanical systems are made or where the cost of remodeling, expended in a 12-month period, exceeds 50% of the current assessed value - $25.00 plus $0.05 per gross square feet of area remodeled.
      (3)   Minimum building permit application fee - $25.00.
      (4)   No building permit application fee shall be required by the following types of construction (all such construction shall be covered by the zoning permit application fee, as per division (A) above) -
         (a)   Fences and signs.
         (b)   Patio construction without roofs and side walls.
         (c)   Accessory uses such as swimming pools, tennis courts, driveways, parking areas, and the like.
   (H)   Fees not returnable. Fees required in any of the foregoing regulations or in any parts of the city's zoning ordinance shall not be returnable for any cause, regardless of outcome of decision on any application. No fee or any part thereof shall be refunded once an application has been advertised for public hearing, where applicable.
