Before a permit shall be issued to any person to make openings or excavations under this subchapter, there shall be delivered to the City Treasurer a cash deposit to cover the cost of replacing, backfilling, or reconstructing the openings so made. The applicant may, at his option, execute and deliver to the city a bond, with corporate surety to be approved by the City Treasurer and filed with the City Council, such bond to be in an amount fixed by the Building Inspector to cover the cost of replacing, backfilling, or reconstructing the openings made in streets, sidewalks, grassplots, alleys, or other public ways and restore the same to their former condition or in a manner to be approved by the Public Works Department. Under such bond, the person securing the permit and his surety shall bind themselves that they will, after they have notified the Building Inspector that such reconstruction work has been completed, pay to the city, on demand, such amount in damages as will be necessary to restore such streets, sidewalks, grassplots, or other public ways either to their former condition and in a manner satisfactory to the Building Inspector, the amount of such damage to be determined by the Building Inspector.
