§ 90.16 LICENSE AND REGISTRATION PROVISIONS; REGULATIONS AND ANTI-RABIC PROVISIONS.
   (A)   Required; fee. All dogs kept, harbored, or maintained in the city shall be licensed and registered with the Kenton County Animal Shelter.
   (B)   Collar. Every owner shall be required to provide each dog with a collar to which the license tag must be affixed and shall see that the collar and tag are constantly worn on the dog.
   (C)   Application of state and county requirements. The licensing and registration herein required shall be in addition to all licenses, registrations, and vaccination requirements of the State of Kentucky, or County of Kenton by law or regulation.
   (D)   Burden of proof. Any dog not bearing a license tag as herein required shall prima facie be deemed to be unlicensed and unregistered and, in any proceeding under this subchapter, the burden of proof of the fact that a dog has been licensed and registered shall be on the owner of the dog.
   (E)   Anti-rabic vaccine.
      (1)   It shall be the duty of every person who owns or harbors a dog or cat in the city to have such dog or cat inoculated with an anti-rabic vaccine by a veterinarian during the months of January through August of each year. Failure to have such dog or cat so inoculated during the period shall subject each person to the penalty hereinafter provided.
      (2)   Every owner or harborer of a dog or cat, upon obtaining the tag from a veterinarian, shall immediately attach the same to the collar or harness of said dog or cat to be worn by said dog or cat at all times. The certificate obtained from the veterinarian shall be retained by the owner or harborer of said dog or cat for inspection by officials of the Police Department or other empowered officials of the city.
      (3)   The anti-rabic provisions shall not apply to dogs or cats kept by regularly chartered medical colleges or other educational or scientific institutions to be used for scientific purposes.
   (F)   Limitation on number of dogs and cats.
      (1)   It shall be unlawful to keep at any one residence within the city limits more than five dogs or cats, or any combination thereof with the exception that the owner or person who has custody of a dog or cat may retain the puppies or kittens, born of said dog or cat which exceed the permissible numbers set forth in this division for a period of 12 weeks after the birth of the animals. Any retention of dogs or cats in excess of the number specified in this division after this 12-week period will constitute a violation of this division.
      (2)   Any person having custody of dogs or cats in excess of the number permitted by this division shall have 30 days from the effective date of this chapter in which to reduce the number of dogs and cats in their custody to comply with this division.
