§ 115.63 RETENTION OF ACQUIRED PERSONAL PROPERTY.
   All personal property received by a second hand dealer under this subchapter shall be held intact by the dealer/licensee for at least seven business days after the dealer/licensee has submitted the required data set forth by the Fort Wayne Police Department using the Records Data Management System used by the Fort Wayne Police Department to record said data. Whenever any dealer/licensee receives notice, by electronic means, telephone, or in-person means, from a law enforcement agency/officer, or from an individual, that a claim of right to possession of the personal property adverse to the dealer/licensee, the dealer/licensee shall maintain custody of the property for 30 days or turn it over to the local law enforcement agency if so required by the law enforcement agency, or unless a civil-agreement between the dealer/licensee and the person(s) claiming right to possession is reached. If, after that required time period, property is not seized by law enforcement, or a civil agreement has not been reached, said property shall be released to the dealer/licensee by the Law Enforcement Agency, if held by them.
