(A) Vacation homes are permitted by conditional use in the following zoning districts with the special conditions indicated below and additional requirements as specified by the Planning and Zoning (P&Z) Commission and City Council:
(1) General Commercial Zoning District (§ 159.335).
(a) Shall be compatible with the adjacent operations;
(b) Shall be screened as deemed appropriate by the Planning and Zoning Commission from view from the adjacent properties;
(c) No parking of camping units within public rights-of-way; and
(d) Vacation home shall have access to an improved public road.
(2) Highway Commercial Zoning District (§ 159.355).
(a) Shall be compatible with the adjacent operations;
(b) Shall be screened as deemed appropriate by the Planning and Zoning Commission from view from the adjacent properties;
(c) No parking of camping units within public rights-of-way;
(d) Vacation home shall have access to an improved public road; and
(e) SDDOT-approved access from the state highways, or access to vacation home is from city streets.
(3) Park and Riverfront District (§ 159.415).
(a) Shall be compatible with the adjacent operations;
(b) Shall be screened as deemed appropriate by the Planning and Zoning Commission from view from the adjacent properties;
(c) No parking of camping units within the public rights-of-way; and
(d) Vacation home shall have access to an improved public road.
(4) Planned Development District (§ 159.430).
(a) Shall be permitted by the Planned Development District and by the district bylaws and covenants, if any;
(b) The Planned Development District shall be a minimum of one acre in size or be surrounded by property not usable for residential use of an area of one acre or more;
(c) Shall be screened as deemed appropriate by the Planned Development District and the Planning and Zoning Commission from view from the adjacent properties;
(d) Shall be compatible with the adjacent operations;
(e) No parking of camping units within the public rights-of-way; and
(f) Vacation home shall have access to an improved public road.
(B) Upon receiving a conditional use permit, a vacation home must also obtain an annual city license as indicated in § 156.05 of this chapter.
(C) The vacation home shall not be exempt from any zoning requirements or regulations of the zoning district in which the vacation home is located.
(D) Vacation homes are prohibited in floodways. Vacation homes are excluded from the Industrial and Sale Barn Districts.
