The Director of Public Works or his or her designee shall cause the application to be heard by the City Council or Board of Adjustment and Appeals, at which time the Council may adopt a resolution approving the building permit for the facility conditioned upon the approval of all plans and Fire Code regulations by the office of the State Fire Marshal. Upon execution of the resolution by the Council conditionally approving the building permit, the applicant shall submit a copy of the resolution and the plans and specifications to the state’s Division of Commercial Inspection and Regulation for its approval. Upon receipt of approval by the Division of Commercial Inspection and Regulation, the building permit will be issued and construction may begin.
