§ 31.37 PUBLIC WORKS DIRECTOR.
   (A)   Establishment. The office of Public Works Director is hereby established.
   (B)   Appointment. The Public Works Director shall be appointed by the Mayor, with the approval of the City Council pursuant to KRS 83A.080; and may be removed by the Mayor at will.
   (C)   Qualifications. The Public Works Director shall:
      (1)   Possess a bachelor’s degree from an accredited college or university; and
      (2)   (a)   Possess a master’s degree in construction management, business administration, public administration, or a closely related field; with at least three years’ experience at the general manager or contractor level;
         (b)   Have had at least five years’ experience as a Kentucky-licensed architect;
         (c)   Have had at least five years’ experience as a Kentucky-licensed engineer;
         (d)   Have had at least five years’ experience as a general contractor in construction that includes overall responsibility for designing, supervising, and ensuring construction according to plans and specifications on construction projects totaling at least $750,000 per year for each of the five years; or
         (e)   Have had at least five years’ experience as the Director of Public Works for a city with a population of at least 3.500; and
      (3)   Submit to and successfully pass a medical examination conducted by a licensed physician approved by the Mayor.
   (D)   Oath; bond. No person shall be appointed or act as the Public Works Director unless the person has taken the oath required by Section 228 of the Constitution of the Commonwealth of Kentucky, and has provided a bond in conformance with § 31.01(B).
   (E)   Powers and duties.
      (1)   Administer and enforce the uniform state building code and all zoning, building, and construction codes, ordinances, and regulations of the city as the official indicated therein, including performing the duties of Building Inspector and Zoning Administrator, to be responsible therefor, with the exception of those relating to fire prevention and protection pursuant to KRS Chapter 227; and
      (2)   Supervise, control, and be responsible for the operation of the Department of Public Works; be responsible for the maintenance and repair of city buildings, streets, and properties, and the performance of the functions and duties of the personnel thereof; and ensure that sufficient equipment and supplies necessary therefor are acquired and maintained.
      (3)   Manage, oversee, plan, and direct outside contractors and engineers in the maintenance, repair, and rebuilding of city streets.
      (4)   Included in the authority, powers, duties and responsibilities of this office or position are those of a citation officer as provided in KRS 83A.087.
   (F)   Compensation. The compensation of the Public Works Director shall be in the amount as established by City Council in the pay and classification plan.
