(A) For the purpose of enforcing this section of the subchapter, the issuing authority shall be the City Zoning Administrator. This individual shall be responsible for the administration and enforcement of this subchapter, including the issuance of required permits.
(B) Applicants shall file a written application and indemnification statement on forms provided by the city with the Zoning Administrator, and shall pay an annual encroachment permit fee (see § 97.55) in an amount sufficient to cover the city's costs of administering the provisions of these regulations. The written application shall contain the following information:
(1) The name, address and telephone number of the permit holder who is the person/entity responsible for the newsrack;
(2) The name, address and telephone number of the person whom the city may notify or contact at any time concerning the permit holder's newsracks;
(3) The number, location, position, and installation method of newsracks shown on a scaled map, drawing or aerial photograph. (In the case that the city has prepared a map designating specific locations for newsracks, the applicant shall be required to identify the number of newsracks and the proposed locations on such map. The city reserves the right to identify separate locations for city-owned newsracks);
(4) Names of newspapers or periodicals to be contained in each newsrack, their frequency of distribution and restocking schedule;
(5) If applicable, the type or brand of newsracks, including an illustration and description of the newsrack and proposed installation method;
(6) Signature of the permit holder; and,
(7) A signed and notarized indemnification statement.
(C) Within seven days of receipt of an application, and upon determination that the permit holder is in compliance with the provisions of this subchapter, the Zoning Administrator shall issue the encroachment permit for installation by the permit holder.
(D) If an application for an encroachment permit for the installation of a newsrack is denied, the applicant shall be advised of the specific cause of such denial by the Zoning Administrator. The applicant may reapply for the permit at no additional cost or may appeal the decision pursuant to § 97.60 of this subchapter.
(E) If at any time following the initial application for an encroachment permit, a permit holder wishes to install additional newsracks, then divisions (B), (C) and (D) of this section shall be repeated in accordance with the provisions of this section. Additional newsrack fees shall be in accordance with § 97.55(A).
