§ 35.01 FIRE CHIEF.
   (A)   The city hereby establishes the office of Fire Chief.
   (B)   The position of Fire Chief shall be filled by appointment of the Mayor with the approval of the City Council.
   (C)   The Fire Chief shall do the following.
      (1)   Plan, organize, direct, coordinate, and evaluate the activities and programs of the municipal Fire Department, including members of the Volunteer Fire Department.
      (2)   Maintain surveillance of various fire science problems.
      (3)   Supervise and evaluate the use of all fire equipment.
      (4)   Accept all of the responsibilities and duties of the Fire Chief as set forth in the personnel ordinance of the city.
      (5)   Possess all the necessary powers and authority to carry out the functions of this office as conferred upon him by law.

   (D)   Compensation shall be in the amount as established by the City Council from time to time as set forth in the city's personnel and pay classification plan.
   (E)   No person shall be appointed or act as the Fire Chief unless such person has taken the oath required by section 228 of the Constitution of the Commonwealth of Kentucky and has provided bond, in the amount of $5,000, with corporate surety authorized to transact business in Kentucky and conditioned upon the performance of the duties specified herein.
