§ 72.04 ON-STREET HANDICAP PARKING.
   (A)   A physically handicapped person may hereafter submit application to the City Administrative Officer or his representative for a designated on-street handicap parking space. The applicant shall meet all of the following criteria to qualify for a designated on-street handicap parking space:
      (1)   The applicant must provide proof of a handicap license plate pursuant to KRS 186.042; or a disabled veteran license plate pursuant to KRS 186.041; or a special handicap parking permit issued by the Campbell County Clerk pursuant to KRS 189.456.
      (2)   The applicant must own an automobile and possess a valid operator's license.
      (3)   The applicant must provide a copy of the deed showing ownership of the parcel of property where the on-street handicap parking space will abut or, if the residence is rented, the applicant must provide written authorization from the owner indicating there is no objection to the on-street handicap parking space.
      (4)   The applicant's residence must lack available off-street parking.
      (5)   The proposed on-street handicap parking space must not interfere with public safety and other necessary public services.
   (B)   The following procedural guidelines shall be observed when making application for an on-street handicap parking space:
      (1)   A completed application form shall be submitted to the Office of the City Administrative Officer. All supporting documentation shall be submitted at the time of application.
      (2)   The application and supporting documentation will be reviewed by the City Administrative Officer or his representative to ensure compliance with the criteria as contained in division (A) of this section.
      (3)   A decision to approve or deny a request will be made in writing to the applicant within 14 calendar days after receipt of application by the city.
      (4)   If an application for on-street handicap parking space is approved, an application fee of $50 shall be submitted to the city before final processing of an application will occur.
      (5)   The city Department of General Services will install a handicap parking sign and paint a portion of the curb abutting the applicant's address in order to designate the on-street handicap parking space.
      (6)   The on-street handicap parking space designation shall expire on December 31 of each year. The applicant shall be required to reapply to the office of the City Administrative Officer within 30 days after said expiration to provide proof that the on-street handicap parking designation remains warranted. A reapplication fee of $5 shall be submitted at the time of reapplication.
      (7)   Any handicapped person having the proper handicap designation on the vehicle may utilize an on-street handicap parking space. Only vehicles without the proper handicap parking designation will be ticketed.
   (C)   Public buildings, churches, schools, and places of assembly shall also be eligible to apply for an on-street handicap parking space. Such requests shall be considered by the Board of Council on a case by case basis.
   (D)   Any person denied an on-street handicap parking space under divisions (A) and (B) above may appeal the decision to the Board of Council within 30 days after receipt of written notification from the city.
