(A) The International Property Maintenance Code, 2009, is hereby amended and revised in the following respects:
(1) Insert “City of Ft. Thomas, KY” at Section 101.1 at page 1.
(2) Any reference to an “International” code shall be interpreted as referring to the parallel or equivalent code of the state of Kentucky or the City of Ft. Thomas, KY.
(3) Replace language of Section 103.1 at page 2 to read “The Building Inspector and/or Zoning Administrator, or any other official designated by the city shall be the code official responsible for the administration and enforcement of this code.”
(4) Omit Section 103.2 at page 2 in its entirety.
(5) Omit Section 103.5 at page 2 in its entirety.
(6) Amend Section 106.4 at page 3 to provide for penalties for violations by adding to the end of the first sentence to read “shall be prosecuted within the limits provided by state or local laws and shall, upon conviction, be subject to a fine of not less than $10.00 nor more than $500.00 or imprisonment for a term not to exceed 180 days, or both, at the discretion of the court.
(7) Change Section 112.4 at page 7 at the last sentence to read “shall be liable for penalties as set forth in Section 106.4.
(8) Omit Section 302.4 at page 11 in its entirety.
(9) Omit Section 302.8 at page 11 in its entirety.
(10) Omit Section 303.2 at page 11 in its entirety.
(11) Omit Section 304.3 at page 12 in its entirety.
(12) Change Section 307.1 at page 15 to read “Handrails shall not be less than 34 inches high or more than 38 inches high measure vertically above the nosing of the tread or above the finished floor of the landing or walking surfaces. Guards shall not be less than 36 inches high above the floor (42 inches if property is covered under the Kentucky Building Code) of the landing, balcony, porch, deck or ramp or other walking surface.”
(13) Change Section 602.3 at page 21 regarding heating to read “....shall supply heat during the period from October 1 to May 15 to maintain a temperature of not less than 68° F (20° C) in all habitable rooms, bathrooms and toilet rooms.”
(14) Change Section 602.4 at page 21 regarding heating to read “.....shall be supplied with heat during the period from October 1 to May 15 to maintain a temperature of not less than 65° F (18°C) during the period the spaces are occupied.”
(15) Omit Section 704 at pages 25-26 in its entirety.
(B) The before-mentioned sections or portions of sections have been omitted or revised from the City of Fort Thomas International Property Maintenance Code for the reason that the sections are more comprehensively addressed in the City of Fort Thomas Official Zoning Ordinance or Code of Ordinances.
