Sec. 2-78.  Contracts without competitive bidding.
   The council, upon the recommendation of the purchasing officer or requesting department head, may authorize the execution of a contract without competitive sealed bidding for purchases over five thousand dollars ($5,000) if:
   (1)   The material, product or service is available from only one vendor (sole-source purchase); or
   (2)   A public emergency will not permit a delay resulting from competitive solicitation; or
   (3)   After solicitation of a number of sources, competition is determined inadequate; or
   (4)   The city could obtain a substantial benefit (economic, time, quality, etc.) not otherwise obtainable if competitive bids were secured.
   The city manager is authorized to make such non-competitive purchases if they qualify under the above circumstances and if valued at less than five thousand dollars ($5,000).
