(A) Whenever the town receives a personal or business check which is returned for insufficient funds, the town shall collect from the individual or business who wrote the check the face amount of the check and an insufficient funds fee in the amount of $25, and all other just and adequate relief provided by law.
(B) The Town Court shall not accept personal or business checks for payment of the fines for the violation of the Traffic Code. Payment of fines for violation of the Traffic Code to the Town Court shall be made by money order or cashier's check. If an individual makes payment to the Town Court by personal or business check, the check shall be refused and returned. In addition to returning the check, the Town Court shall collect a fee of $10 for each check returned. This fee shall be paid either by the individual or business who wrote the check or by the individual or business charged with violating the Traffic Code.
(C) The fee provided for under this section is imposed to cover administrative time and expenses involved with the processing and returning of checks. The fee shall not be deemed a punishment for violation of the Traffic Code.
(D) The fee imposed by the Town Court is hereby made retroactive to January 1, 2007.
