§ 32.02 POWERS AND DUTIES.
   (A)   The Clerk-Treasurer may administer oaths, take depositions and take acknowledgments of instruments as required by law.
   (B)   The Clerk-Treasurer is the Clerk of the Town Council and whenever the Town Council has an even number of members, the Clerk-Treasurer is an ex-officio member for the purpose of casting the deciding vote to break the tie.
   (C)   The Clerk-Treasurer may perform all duties prescribed by law, which include but are not limited to the following:
      (1)   Receive and care for all town monies, and pay them out upon order of the Town Council;
      (2)   Keep accounts of all town monies;
      (3)   File monthly reports with the Town Council showing all receipts and disbursements of the Town Treasury for the preceding month;
      (4)   Maintain records which are open for inspection by the Town Council;
      (5)   Collect fines resulting from ordinance violations;
      (6)   Issue all licenses;
      (7)   Attend all Town Council meetings and maintain a recording of its proceedings; and
      (8)   Division (C)(1) above notwithstanding, to pay out prior to regular Town Council meeting and in advance of allowance of the claim by the town Council, town funds in order to meet obligations of the town which fall due prior to regular Town Council meetings, with respect to the following types of claims which disbursements are hereby pre-approved for lawful town purposes:
         (a)   Property or services purchased or leased from:
            1.   The U.S. government; or
            2.   An agency or a political subdivision of the United States government.
         (b)   License fees or permit fees;
         (c)   Insurance premiums;
         (d)   Utility payments or utility connection charges;
         (e)   Federal grant programs if:
            1.   Advance funding is not prohibited; and
            2.    The contracting party provides sufficient security for the advanced amount.
         (f)   Grants of state funds authorized by statute;
         (g)   Maintenance agreements or service agreements;
         (h)   Lease agreements or rental agreements;
         (i)   Principal and interest payments on bonds;
         (j)   Payroll;
         (k)   State, federal or county taxes;
         (l)   Employee health insurance co-payment;
         (m)   Travel related expenses which are authorized pursuant to this code;
         (n)   Payment to employees for flexible spending account;
         (o)   Payment to local vendors for gas used by employees for town vehicles;
         (p)   Payment to employees for reimbursable work expenses: shoes, and the like;
         (q)   Credit card payments;
         (r)   Anything that would incur a late fee or constitute a savings if paid by a certain due date;
         (s)   training and class registrations if due before a council meeting; and
         (t)   Items disbursed from the clearing account;
         provided that each disbursement made under the authority of this division is supported by a fully itemized claim and the Town Council reviews and allows the claim at the next regular or special meeting following the payment of said claim.
   (D)   The Clerk-Treasurer is both the Town Clerk and Town Fiscal Officer pursuant to I.C. 36-5-6-2.
