§ 113.05 PERMIT TO PLACE COMMERCIAL GOODS ON A TOWN SIDEWALK.
   A person who desires to place or keep commercial goods on or above a town sidewalk in the Central Business District may apply to the Clerk-Treasurer for a permit to do so. The Clerk- Treasurer shall issue such a permit, subject to the following limitations:
   (A)   The permit shall require the applicant to provide:
      (1)   The name and address of any person who has an ownership interest in such business;
      (2)   The full legal name and address of the business; and
      (3)   A signed statement agreeing to operate the business strictly in accordance with the requirements of this chapter and indemnifying the town against all loss as a result of issuing such a permit.
   (B)   The permit shall only allow the permittee to place or keep commercial goods on or above a town sidewalk on the first weekend of each month.
   (C)   No more than two permits shall be issued to a person each year.
   (D)   Each permit shall last five days; provided, however, that no permit shall extend beyond the end of the calendar year in which it is granted.
   (E)   The Clerk-Treasurer may not charge a fee for such a permit.
   (F)   The permittee has submitted proof of insurance as required by this chapter.
   (G)   The permittee has not been subject to the revocation of a prior permit under this chapter within the last six months.
   (H)   The Clerk-Treasurer may revoke or deny any permit upon a finding of:
      (1)   Any fraud, misrepresentation, or false statement contained in the application or in conjunction with an enforcing officer's investigation;
      (2)   Any violation of this chapter;
      (3)   The person's conviction of any felony or of a misdemeanor involving moral turpitude; or
      (4)   Unlawful business practices, or those that constitute a breach of the peace.
