§ 50.07 UNDERGROUND OR BURIED UTILITIES.
   (A)   Area designation. The Council hereby designates all areas of the town over which it has jurisdiction, whether the area is publicly or privately owned, as "strictly for underground or buried utilities," except that, the physical space occupied by any currently existing aboveground utility is not so designated.
   (B)   Regulation of existing utility pole. To the maximum extent permitted by law, no utility shall be attached to an existing utility pole, as defined by I.C. 8-1-32.3-12 (recently enacted legislation).
   (C)   Scope. The above designation shall be true and effective for any permit authority, as defined by I.C. 8-1-32.3-8 or as amended or renumbered, under the Council's authority and/or jurisdiction.
   (D)   Designation of emergency, urgent necessity. The meeting during which this section was considered was convened under urgent necessity and/or emergency circumstances that present actual or threatened disruption of governmental activity within the town.
