§ 150.041 SIDEWALKS.
   (A)   Required improvements.
      (1)   Sidewalks shall be included within the dedicated, unpaved portions of the rights-of-way of all streets as shown in Appendix B.
      (2)   Concrete curbs are required for all streets where sidewalks are required by this chapter or required at the discretion of the Commission.
      (3)   A grassed or landscaped median strip at least 2 feet wide shall separate all sidewalks from adjacent curbs. The medial strip shall be improved according to § 150.036(D) of these regulations.
   (B)   Pedestrian accesses. In order to facilitate pedestrian access from the street to schools, parks, playgrounds or other nearby streets, the Commission may require perpetual unobstructed easement at least 20 feet in width. The easements shall be indicated on both the preliminary and final plats.

   (D)   Guidelines for the construction and rehabilitation of sidewalks.
      (1)   Before construction begins on any new residential structure within the town, the landowner shall obtain a sidewalk permit from the town. All new residential structures will be required to obtain a sidewalk permit and the landowner will be required to construct a sidewalk in accordance with all specifications adopted by the Town of Fremont.
      (2)   A landowner of an existing residential structure without a sidewalk which is issued an improvement location permit will not be required to obtain a sidewalk permit or construct a sidewalk.
      (3)   All existing residential structures that are issued an improvement location permit and have an existing sidewalk that the landowner wishes to rehabilitate or do not have an existing sidewalk but wish to construct one shall obtain a sidewalk permit and construct a sidewalk in accordance with all specifications adopted by the Town of Fremont. The Town of Fremont may provide a portion or all of the labor to remove the existing sidewalk and/or share the cost of the new sidewalk construction, dependent upon availability of town funds. In no event shall the maximum contribution of the Town of Fremont exceed $1,000 for a mid-block residence or $2,000 for a corner residence.
      (4)   Any owner of a residential structure within the corporate boundaries of the Town of Fremont that wishes to repair an existing sidewalk or construct a new sidewalk shall obtain a sidewalk permit and the landowner will be required to construct a sidewalk in accordance with all specifications adopted by the Town of Fremont. The cost of said construction may be equally shared between the Town of Fremont and the landowner, dependant upon availability of town funds. In no event shall the maximum contribution of the Town of Fremont exceed $1,000 for a mid-block residence or $2,000 for a corner residence.
      (5)    The Town of Fremont shall annually utilize all available funds budgeted for the purposes stated in this division in those areas where the Town Council and the Town Manager deem the need most pressing. Bids shall be solicited in the late spring of each year with construction to be initiated in late summer of each year.
      (6)   All funds of the town budgeted for the purposes stated hereunder shall be distributed on a first come, first served basis. No project shall have a guarantee with regard to the availability of match funds under this division.
      (7)   Applications for town matching funds under this division may be made upon the issuance of a sidewalk permit or at any time as the need for sidewalk construction becomes warranted. Submission to the town by the applicant of at least 2 bids will be required and payment shall be made to said applicant after completion of construction and inspection by the town.
      (8)   A portion of all funds budgeted each year for sidewalks shall be utilized by the Fremont Street Department for the rehabilitation of sidewalks damaged by tree removal or like circumstances.
