Notwithstanding any provisions to the contrary, when it is necessary for the protection of public health and safety, such as in conditions of extreme drought, the Town Council of the Town of Fremont may prohibit the use of any and all consumer fireworks. The Town Council may only prohibit the use of any and all consumer fireworks for so long as the emergency or conditions justify their prohibition.
