(A) For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
STREET TREES. Trees, shrubs, bushes and all other woody vegetation on land lying between property lines on either side of all streets, highways, avenues, alleys or ways, or which overhang any streets, highways, avenues, alleys, sidewalks or ways within the town.
TREE LAWN. That area of land between a parcel of privately-owned property and any road, street or highway, but which is actually included within the road, street or highway right-of-way.
(B) The Committee shall recommend to the Town Council the town street tree planting specifications (specifications). Subject to Town Council approval, these specifications shall list the official street tree species for the town. The specifications shall also contain the minimum distances between the trees and other trees and structures which must be followed for the planting of any tree under this chapter. The Town Council may amend the specifications from time to time with advice from the Board.
(C) No species other than those included in the specifications may be planted on the tree lawn without written permission of the Board.
(D) The spacing of street trees shall be in accordance with the specifications, and no trees shall be planted closer to another tree or structure except as recommended in the specifications unless in special plantings designed or approved by a landscape architect or forester, and then approved by the Board.
