§ 52.47 PORTION OF WATER NOT ENTERING SEWERAGE SYSTEM.
   (A)   General.
      (1)   Where a significant portion of the metered water does not and cannot enter the sewerage system, either directly or indirectly, and where the quantity of water entering the premises averages more than 20,000 gallons per month, the person having charge of the property may request permission from the town to install at his or her own expenses either an approved meter or meters to determine the quantity of water that cannot enter the sewerage system or an approved sewage-measuring device or devices to determine the volume of sewage that actually enters the sewerage system.
      (2)   Facilities used to accomplish this shall be maintained in a serviceable condition by the user at his or her expense.
      (3)   When appropriate, the town reserves the right to determine whatever other means and methods is may find practicable the percentage of the property metered water that enters the sewerage system.
      (4)   In any case the user charge shall be applied to the quantity of water that can or actually does enter the public sewers.
   (B)   Seasonal residential rates.
      (1)   (a)   The sewage service for residential users in the town which are not separately measured from their water flow meters for the usage periods of April 15 to May 15, billable on June l, May 15 to June 15 billable on July 1, June 15 to July 15, billable on August 1, and July 15 to August 15, billable on September l of each year, subject to the conditions set forth in this below.
         (b)   Divisions (2) through (5) are to be based upon the average water usage of the immediately preceding months of December, January, February, and March, subject to a 6,000 gallon minimum monthly usage. If the actual water consumption during the usage periods is less than 6,000 gallons per month, the actual reading will be used.
      (2)   In order to qualify for the division (1) usage rate, the user must file a 1 time only application for the summer sewage rates. In order to make application, the Clerk-Treasurer's office will establish a form that can be filled out as water and sewer service is established.
      (3)   The above rates shall apply solely to single family residents which do not include any commercial home occupation which uses water for commercial purposes.
      (4)   The Council further reserves the right to deny the alternative rate to any user who is abusive with respect to water or sewer consumption.
      (5)   The Clerk-Treasurer is hereby authorized to establish rules, forms, and regulations to implement the terms of this section.
