This chapter applies to all development areas having new, renovations or relocated projects, or those involving highways, underground cables, pipelines, residential subdivisions, industrial projects, commercial projects, institutional projects, building activities on farms, general clearing, earth disturbing activity, redevelopment of urban areas and all other land uses not specifically exempted. All projects are subject the regulations and enforcement of the City of Fremont's general National Pollutant Discharge Elimination System (NPDES) permit issued by the Ohio Environmental Protection Agency (OEPA) and Best Management Practices (BMPs) regardless of its size and type. Any project disturbing one (1) acre or more is also required to secure either a general or individual NPDES permit depending on the project type. A copy of the approved permit shall be submitted to the City prior to the work beginning and in accordance to the OEPA regulations outlined in the permit. The City Engineer shall make determination of all project requirements and application of this ordinance. This chapter does not apply to:
(a) Land disturbing activities related to producing agricultural crops or silviculture operations regulated by the Ohio Agricultural Sediment Pollution Abatement Rules (1501:15-3-01 to 1501:15-3-09 of the Ohio Administrative Code) and existing at the time of passage of this chapter.
(b) Transportation projects that are subject to industry specific Ohio EPA Rules are exempt from these requirements.
