(a) No person shall kindle or maintain any bonfire or burn leaves, rubbish, grass or other combustible materials on private property except by burning in an approved container or enclosure and such containers or enclosures shall not be nearer than ten feet of a property line and shall not be nearer than ten feet to any building or other combustible material unless otherwise specified by the Fire Chief. In no event shall burning be permitted under the conditions specified in this section between the hours of 9:00 p.m. and 6:00 a.m. of any day, Tuesday through Friday, of any week or between the hours of 9:00 p.m. Saturday through 6:00 a.m. Tuesday. In no event shall burning of garbage or green vegetation or other material which produce heavy amounts of smoke or odor be permitted under the conditions specified in this section.
(b) Approved containers or enclosures for burning shall consist of wire, metal, concrete or similar nonflammable materials and shall be completely enclosed with all openings so constructed as not to permit the emission of particle in sufficient number to cause annoyance to any other person, provided that the particles are sufficiently large as to be visible individually at the emission point or of such size and nature as to be visible individually as incandescent particles and such particles fall on the property other than the property of the person permitting such emission.
